Privacy Policy

1) Introduction and Contact Details of the Controller

1.1 We are pleased that you are visiting our website, and thank you for your interest. Below we inform you about how we handle your personal data when you use our website. Personal data is any data that can be used to personally identify you.

1.2 The controller responsible for data processing on this website within the meaning of the General Data Protection Regulation (GDPR) is Sandra Zöllner, Boddenglück Ferienvermietung, Strandstraße 26, 18347 Dierhagen, Germany, Tel.: 038226-537353, Fax: 034605 20109, Email: [email protected]. The controller for the processing of personal data is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data.

2) Data Collection When Visiting Our Website

2.1 When you use our website purely for informational purposes, i.e. if you do not register or otherwise provide us with information, we only collect the data that your browser transmits to our server (so-called "server log files"). When you access our website, we collect the following data, which is technically necessary for us to display the website to you:

  • The website visited
  • Date and time at the time of access
  • Amount of data sent in bytes
  • Source/reference from which you came to the page
  • Browser used
  • Operating system used
  • IP address used (if applicable, in anonymized form)

The processing takes place in accordance with Art. 6 (1) (f) GDPR on the basis of our legitimate interest in improving the stability and functionality of our website. The data is not passed on or used in any other way. However, we reserve the right to subsequently check the server log files if there are concrete indications of unlawful use.

2.2 For security reasons and to protect the transmission of personal data and other confidential content (e.g. orders or inquiries to the controller), this website uses SSL or TLS encryption. You can recognize an encrypted connection by the "https://" prefix and the padlock symbol in your browser's address bar.

3) Hosting & Content Delivery Network

For hosting our website and displaying the page content, we use a provider that provides its services itself or through selected subcontractors exclusively on servers within the European Union.

All data collected on our website is processed on these servers.

We have entered into a data processing agreement with the provider that ensures the protection of our website visitors' data and prohibits unauthorized disclosure to third parties.

4) Cookies

In order to make visiting our website attractive and to enable the use of certain functions, we use cookies, i.e. small text files that are stored on your device. Some of these cookies are automatically deleted after the browser session ends (so-called "session cookies"), while others remain on your device for longer and enable page settings to be saved (so-called "persistent cookies"). In the latter case, you can find the storage period in the overview of your web browser's cookie settings.

Insofar as personal data is also processed through individual cookies we use, the processing takes place either in accordance with Art. 6 (1) (b) GDPR for the performance of the contract, in accordance with Art. 6 (1) (a) GDPR in the event that consent has been given, or in accordance with Art. 6 (1) (f) GDPR to safeguard our legitimate interests in the best possible functionality of the website as well as a customer-friendly and effective design of the site visit.

You can set your browser so that you are informed about the setting of cookies and decide individually whether to accept them, or exclude the acceptance of cookies for certain cases or generally.

Please note that if you do not accept cookies, the functionality of our website may be limited.

5) Contacting Us

5.1 Own Review Reminder

Solely on the basis of your explicit consent pursuant to Art. 6 (1) (a) GDPR, we use your email address to send a one-time reminder to leave a review of our services after the contract has been fulfilled. You may withdraw your consent at any time by sending a message to the controller.

5.2 When you contact us (e.g. via contact form or email), personal data is processed — solely for the purpose of handling and responding to your inquiry, and only to the extent necessary for that purpose.

The legal basis for the processing of this data is our legitimate interest in responding to your inquiry pursuant to Art. 6 (1) (f) GDPR. If your contact is aimed at concluding a contract, the additional legal basis for the processing is Art. 6 (1) (b) GDPR. Your data will be deleted if it can be inferred from the circumstances that the matter in question has been conclusively clarified, and provided no statutory retention obligations apply.

6) Data Processing for Order Fulfillment

6.1 Insofar as necessary for contract fulfillment for delivery and payment purposes, the personal data collected by us is disclosed to the commissioned transport company and the commissioned credit institution pursuant to Art. 6 (1) (b) GDPR.

Insofar as we owe you updates for goods with digital elements or for digital products on the basis of a corresponding contract, we process the contact data you provided when ordering in order to inform you personally as part of our statutory information obligations pursuant to Art. 6 (1) (c) GDPR. Your contact data is used strictly for the purpose of communications regarding updates owed by us, and is processed by us for this purpose only to the extent necessary for the respective information.

To process your order, we also work with the following service provider(s), who support us in whole or in part in fulfilling concluded contracts. Certain personal data is transmitted to these service providers in accordance with the following information.

6.2 Use of Payment Service Providers

- Stripe

One or more online payment methods from the following provider are available on this website: Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland

If you select a payment method from the provider for which you make an advance payment (such as credit card payment), your payment data provided during the ordering process (including name, address, bank and payment card information, currency, and transaction number) as well as information about the content of your order will be passed on to this provider in accordance with Art. 6 (1) (b) GDPR. In this case, your data is passed on exclusively for the purpose of payment processing with the provider and only to the extent necessary for this purpose.

If you select a payment method where the provider makes an advance payment (such as purchase on account or in installments, or direct debit), you will also be asked during the ordering process to provide certain personal data (first and last name, street, house number, postal code, city, date of birth, email address, telephone number, and, if applicable, data on an alternative payment method).

In order to safeguard our legitimate interest in determining our customers' creditworthiness, this data is forwarded by us to the provider pursuant to Art. 6 (1) (f) GDPR for the purpose of a credit check. Based on the personal data you provide as well as other data (such as shopping cart, invoice amount, order history, payment experience), the provider checks whether the payment method you selected can be granted with regard to payment and/or default risks.

The credit report may contain probability values (so-called score values). Insofar as score values are included in the result of the credit report, they are based on a scientifically recognized mathematical-statistical procedure. Among other things, but not exclusively, address data is included in the calculation of the score values.

You may object to this processing of your data at any time by sending a message to us or to the provider. However, the provider may still be entitled to process your personal data if this is necessary for contractual payment processing.

7) Website Functionalities

7.1 Google Maps

This website uses an online map service from the following provider: Google Maps (API) from Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google").

Google Maps is a web service for displaying interactive maps in order to visually present geographical information. By using this service, our location is shown to you and any directions to us are made easier.

As soon as you access the subpages into which the Google Maps map is embedded, information about your use of our website (such as your IP address) is transmitted to and stored on Google's servers; this may also involve transmission to the servers of Google LLC in the USA. This occurs regardless of whether Google provides a user account through which you are logged in, or whether a user account exists at all. If you are logged into Google, your data will be directly assigned to your account. If you do not want this assignment to your Google profile, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and evaluates them.

The collection, storage, and evaluation take place in accordance with Art. 6 (1) (f) GDPR on the basis of Google's legitimate interest in displaying personalized advertising, market research, and/or the needs-based design of Google's websites. You have the right to object to the creation of these user profiles, and to exercise this right you must contact Google directly. If you do not agree to the future transmission of your data to Google in connection with the use of Google Maps, you also have the option of completely disabling the Google Maps web service by disabling JavaScript in your browser. In that case, Google Maps and thus the map display on this website cannot be used.

To the extent legally required, we have obtained your consent for the processing of your data described above pursuant to Art. 6 (1) (a) GDPR. You may withdraw your consent at any time with effect for the future. To exercise your withdrawal, please follow the option for objecting described above.

For data transfers to the USA, the provider has joined the EU-US Data Privacy Framework, which, on the basis of an adequacy decision by the European Commission, ensures compliance with European data protection standards.

Further information on Google's data protection provisions can be found here: https://business.safety.google/intl/de/privacy/

7.2 - Google reCAPTCHA

On this website, we use the CAPTCHA service of the following provider: Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland

Data may also be transmitted to: Google LLC, USA.

For the visual design of the captcha window, the provider uses "Google Fonts," i.e. fonts loaded from Google via the internet. No processing of information beyond that mentioned above, which is already transmitted to Google via the functionality of reCAPTCHA, takes place.

The service checks whether an entry is made by a natural person or is being abused through machine and automated processing, and blocks spam, DDoS attacks, and similar automated malicious access. To ensure that an action is performed by a human and not by an automated bot, the provider collects the IP address of the device used, identification data on the type of browser and operating system used, as well as the date and duration of the visit, and transmits this to the provider's servers for evaluation. Cookies may be used in this process, i.e. small text files that are stored in the browser of the device.

Insofar as the processing described above is based on cookies, these are only set if you have given us your explicit consent to do so in accordance with Art. 6 (1) (a) GDPR. You may revoke your consent at any time with effect for the future by disabling this service in the "cookie consent tool" provided on the website.

If the processing described above is carried out without the use of cookies, the legal basis is our legitimate interest in determining individual accountability on the internet and preventing misuse and spam pursuant to Art. 6 (1) (f) GDPR.

We have entered into a data processing agreement with the provider that ensures the protection of our website visitors' data and prohibits unauthorized disclosure to third parties.

For data transfers to the USA, the provider has joined the EU-US Data Privacy Framework, which, on the basis of an adequacy decision by the European Commission, ensures compliance with European data protection standards.

8) Tools and Other

Cookie Consent Tool

This website uses a so-called "cookie consent tool" to obtain effective user consent for cookies and cookie-based applications requiring consent. The "cookie consent tool" is displayed to users when they access the page in the form of an interactive user interface, on which consent for certain cookies and/or cookie-based applications can be given by checking a box. Through the use of this tool, all cookies/services requiring consent are only loaded if the respective user gives corresponding consent by checking a box. This ensures that such cookies are only set on the respective user's device if consent has been given.

The tool sets technically necessary cookies in order to store your cookie preferences. Personal user data is generally not processed in this process.

If, in individual cases, personal data (such as the IP address) is nevertheless processed for the purpose of storing, assigning, or logging cookie settings, this takes place pursuant to Art. 6 (1) (f) GDPR on the basis of our legitimate interest in legally compliant, user-specific, and user-friendly consent management for cookies, and thus in a legally compliant design of our website.

A further legal basis for the processing is also Art. 6 (1) (c) GDPR. As controller, we are subject to the legal obligation to make the use of cookies that are not technically necessary dependent on the respective user's consent.

Where necessary, we have entered into a data processing agreement with the provider that ensures the protection of our website visitors' data and prohibits unauthorized disclosure to third parties.

Further information about the operator and the setting options of the cookie consent tool can be found directly in the corresponding user interface on our website.

9) Rights of the Data Subject

9.1 Applicable data protection law grants you the following rights (rights of access and intervention) vis-à-vis the controller with regard to the processing of your personal data, whereby reference is made to the stated legal basis for the respective requirements for exercising these rights:

  • Right of access pursuant to Art. 15 GDPR;
  • Right to rectification pursuant to Art. 16 GDPR;
  • Right to erasure pursuant to Art. 17 GDPR;
  • Right to restriction of processing pursuant to Art. 18 GDPR;
  • Right to notification pursuant to Art. 19 GDPR;
  • Right to data portability pursuant to Art. 20 GDPR;
  • Right to withdraw consent given pursuant to Art. 7 (3) GDPR;
  • Right to lodge a complaint pursuant to Art. 77 GDPR.

9.2 RIGHT TO OBJECT

IF, AS PART OF A BALANCING OF INTERESTS, WE PROCESS YOUR PERSONAL DATA ON THE BASIS OF OUR OVERRIDING LEGITIMATE INTEREST, YOU HAVE THE RIGHT AT ANY TIME, FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION, TO OBJECT TO THIS PROCESSING WITH EFFECT FOR THE FUTURE.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL CEASE PROCESSING THE DATA CONCERNED. HOWEVER, WE RESERVE THE RIGHT TO CONTINUE PROCESSING IF WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS, OR IF THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE, OR DEFENSE OF LEGAL CLAIMS.

IF YOUR PERSONAL DATA IS PROCESSED BY US FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING. YOU MAY EXERCISE YOUR RIGHT TO OBJECT AS DESCRIBED ABOVE.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL CEASE PROCESSING THE DATA CONCERNED FOR DIRECT MARKETING PURPOSES.

10) Duration of Storage of Personal Data

The duration of the storage of personal data is measured against the respective legal basis, the purpose of processing, and — where applicable — additionally against the respective statutory retention period (e.g. retention periods under commercial and tax law).

When personal data is processed on the basis of explicit consent pursuant to Art. 6 (1) (a) GDPR, the data concerned is stored until you withdraw your consent.

If statutory retention periods exist for data processed as part of contractual or quasi-contractual obligations on the basis of Art. 6 (1) (b) GDPR, this data is routinely deleted after the retention periods expire, provided it is no longer required for contract performance or initiation and/or we no longer have a legitimate interest in continued storage.

When personal data is processed on the basis of Art. 6 (1) (f) GDPR, this data is stored until you exercise your right to object pursuant to Art. 21 (1) GDPR, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or the processing serves the establishment, exercise, or defense of legal claims.

When personal data is processed for the purpose of direct marketing on the basis of Art. 6 (1) (f) GDPR, this data is stored until you exercise your right to object pursuant to Art. 21 (2) GDPR.

Unless otherwise indicated by the other information in this policy regarding specific processing situations, stored personal data will otherwise be deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
